Welcome to Pixys. These Terms of Service (“Terms”) explain the rules for using our platform at https://pixys.info/. By creating an account or using our services, you agree to these Terms.

Our analysis is for informational purposes only. You are solely responsible for your investment decisions and should consult with qualified financial professionals before making investment decisions.

4.3 Data Sources & Accuracy

We strive for accuracy, but:

  • Data comes from third-party sources (SEC, SEDAR, financial APIs) which may contain errors
  • Stock prices and company information may be delayed
  • Analysis is based on available information at the time of publication
  • Companies and markets change; past analysis may become outdated

Always verify critical information from primary sources (company filings, official announcements) before making investment decisions.

5. Subscription Plans & Payments

5.1 Free Tier

Our free tier provides:

  • Access to curated low-to-medium risk company analyses
  • Basic portfolio tracking
  • Access to free Discord community channels

5.2 Paid Subscriptions

Paid tiers include:

  • Access to higher-risk/higher-reward company analyses
  • Real-time alerts on rating changes
  • Company news notifications
  • Exclusive Discord channels
  • Additional features as we develop them

Pricing: Subscription fees are displayed on our pricing page and are subject to change with 30 days’ notice.

5.3 Payment Processing

  • Payments are processed securely through Stripe
  • By subscribing, you authorize recurring charges
  • You’re responsible for all charges incurred under your account
  • All fees are in USD (or currency specified at checkout)

5.4 Billing & Renewal

  • Subscriptions auto-renew unless you cancel
  • You’ll be charged at the start of each billing period
  • We’ll notify you before any price changes
  • If payment fails, we may suspend your subscription until payment is resolved

5.5 Cancellations & Refunds

Cancellation:

  • You can cancel anytime through your account settings
  • Cancellation takes effect at the end of your current billing period
  • You retain access until the period ends
  • No partial refunds for mid-period cancellations

Refund Policy:

  • First-time subscribers: 7-day money-back guarantee (full refund if canceled within 7 days)
  • After 7 days: No refunds for unused time
  • Exception: If we significantly change our service and you cancel within 14 days of notification, we may offer a pro-rata refund at our discretion

Disputes:

  • Contact us first through our contact form if you have billing concerns
  • We’ll work with you in good faith to resolve issues
  • If unresolved, you may dispute charges with your payment provider

6. Acceptable Use Policy

6.1 You May:

✅ Participate respectfully in our Discord community

6.2 You May NOT:

❌ Scrape or data mine: Automated collection of data from our Platform
❌ Resell or redistribute: Share premium content with non-subscribers or use it commercially
❌ Reverse engineer: Attempt to extract our algorithms or proprietary methods
❌ Abuse the system: Create multiple accounts to bypass limits, exploit bugs for gain
❌ Harass others: Spam, abuse, threaten, or harass users or staff
❌ Manipulate markets: Use our Platform to coordinate pump-and-dump schemes
❌ Violate laws: Use Pixys for illegal activities or money laundering
❌ Impersonate: Pretend to be someone else or falsely claim affiliation with Pixys

6.3 Consequences

Violations may result in:

  • Warning and request to cease activity
  • Temporary account suspension
  • Permanent account termination without refund
  • Legal action if warranted

We reserve the right to investigate suspected violations and cooperate with law enforcement.

7. Intellectual Property Rights

7.1 Our Content

All content on Pixys is protected by copyright and intellectual property laws:

  • Analysis, ratings, and methodology
  • Website design, code, and features
  • Logos, trademarks, and branding
  • Educational materials and resources

Ownership: Pixys (and our licensors) own all rights to Platform content.

7.2 Your License to Use

We grant you a limited, non-exclusive, non-transferable license to:

You may NOT:

  • Copy or republish our analysis without permission

7.3 User-Generated Content

If you post content (Discord messages, feedback, etc.):

  • You retain ownership of your content
  • You grant us a license to use, display, and moderate your content
  • You’re responsible for ensuring you have rights to post it
  • We can remove content that violates these Terms

7.4 DMCA & Copyright Claims

If you believe content on Pixys infringes your copyright:

  • Provide details: your contact info, description of copyrighted work, location on our site
  • We’ll investigate and respond according to applicable law

8. Disclaimers & Limitations of Liability

8.1 Investment Risk Disclaimer

READ THIS CAREFULLY:

Investing in resource stocks (or any stocks) carries significant risk, including:

  • Loss of Capital: You can lose some or all of your investment
  • Volatility: Resource stocks can be highly volatile
  • Company Risk: Companies can fail, be delisted, or go bankrupt
  • Market Risk: Broader market conditions affect stock performance
  • Geopolitical Risk: Many resource companies operate in unstable regions

Pixys analysis does NOT guarantee:

  • Future performance or returns
  • Accuracy of predictions or ratings
  • Protection against losses
  • That companies rated highly will succeed

You acknowledge that:

  • Past performance doesn’t predict future results
  • All investments carry risk
  • You should only invest what you can afford to lose
  • You’re solely responsible for your investment decisions

8.2 Service Disclaimer

Pixys is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, including:

No Warranty of:

  • Accuracy, completeness, or timeliness of information
  • Uninterrupted or error-free service
  • Security (though we implement industry-standard measures)
  • Fitness for a particular purpose
  • Non-infringement

We don’t warrant that:

  • Our Platform will meet your expectations
  • Data from third parties is accurate or current
  • Technical issues won’t occur
  • All bugs or vulnerabilities will be fixed

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Pixys and its officers, directors, employees, and affiliates are NOT liable for:

  • Investment Losses: Any losses from investment decisions based on our Platform
  • Indirect Damages: Lost profits, lost data, business interruption
  • Service Interruptions: Downtime, technical issues, data loss
  • Third-Party Actions: Actions of other users, Discord community members
  • External Links: Content or actions on third-party websites
  • Data Breaches: Unauthorized access despite our security measures (though we’ll notify you as required by law)

Maximum Liability: If we are found liable, our total liability is limited to the amount you paid us in the 12 months before the claim (or $100 if you’re a free user).

Exceptions: Some jurisdictions don’t allow limitation of liability for certain damages. If your jurisdiction prohibits this, the above may not fully apply to you.

8.4 Indemnification

You agree to indemnify and hold harmless Pixys from claims, damages, or expenses arising from:

Our Platform may link to:

We’re not responsible for:

  • Accuracy of third-party content
  • Privacy practices of external sites
  • Actions you take on other platforms

10. Privacy & Data Protection

13.3 Effect of Termination

Upon termination:

  • Your access to paid features ends immediately
  • Your data will be deleted according to our Privacy Policy retention schedule
  • Sections that should survive (liability limitations, dispute resolution) remain in effect

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pixys.

14.2 Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.

14.3 No Waiver

Our failure to enforce any right or provision doesn’t constitute a waiver of that right.

14.4 Assignment

You can’t transfer your rights under these Terms. We may assign our rights to a successor or affiliate.

14.5 Force Majeure

We’re not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, wars, pandemics, internet outages, etc.).

14.6 Relationship

These Terms don’t create a partnership, joint venture, employment, or agency relationship between you and Pixys.
